Latest Updates About Cleverbuy / CleverTravel

Just to recap the events since May:
  1. J2 Discount Travel and Tours closed down. Cleverbuy said they would take care of the refunds. Some complainants were able to get post-dated checks.
  2. May 29 - Cleverbuy stopped issuing post-dated checks and only issued promissory notes. A meeting with Cleverbuy was scheduled at NBI on June 1, 2012.
  3. May 30 - Cleverbuy suddenly closed their office as well due to threats, verbal abuse, and a few cases of vandalism and theft received from their angry clients. The closure would be temporary according to them. Communication with them was soon cut off however (no response on their Facebook page, invalid contact numbers, etc).
  4. Anonymous tips and various information from former Cleverbuy employees began surfacing.
  5. June 1 - The meeting at NBI's Anti-Fraud Division was reset to June 8, 2012.
  6. June 5 - The bank account used by Cleverbuy to issue their checks was closed. DTI encouraged complainants to go direct to NBI since this matter had become a criminal case.

A few days ago, I heard from an ex-Cleverbuy employee that the company's CEO Christian Bayer denied being the owner of Cleverbuy. That was certainly odd -- Cleverbuy's SEC registration could disprove his denial. Even in the official statement Cleverbuy issued last May 3, 2012, Bayer was named as the CEO. This denial sent my mind whirring and I began to consider the possibility that Cleverbuy was a scam from the beginning (unknown to their Filipino staff) and Garcia was being used as a fall guy by Bayer (just in case someone needs to go to jail to pacify the angry mob) while Bayer runs away.


What happened during the NBI meeting on June 8, 2012...

Several dozen complainants (including at least two merchants) came to the meeting. News crew from ABS-CBN and TV5 also covered the event. The NBI attorney addressed the complainants first, stating that filing a case with NBI would not guarantee getting a refund since the NBI was not a collections agency and would only handle criminal investigations. If the complainants' goal was to get their money back, they would have to take their case directly to court instead of through the NBI. The attorney emphasized that they were looking for complainants who were determined to see the criminal prosecution to the end -- appearing in court to testify against the accused when needed -- because they did not want to see cases dismissed halfway through, given that the NBI has limited resources and handles a lot of other cases.

Some of the complainants got disheartened with what the attorney said, but it was good that she laid it all out in the open from the start. No false hopes.

Tension built up when the attorney gave us one complaint sheet and asked us to just go out and photocopy it for ourselves. Several people got annoyed that a government agency did not have the resources or the inclination to provide everyone with a form. The attorney was upset that people were making an issue out of it (I actually thought she would walk out). Frankly, I can't blame the complainants for getting annoyed. As one complainant eloquently put it, "It's not about the money but the principle!" If you can't expect a single piece of paper from your government agency, what else can you expect, right? Anyway, that minor conflict was eventually worked out when the complainants shelled out some coins and an NBI custodian had the sheet photocopied.

Later on, I learned from the NBI attorney that she was not happy that her full name and email address got posted online without the "informant" asking her permission first. This surprised me, considering that she works for NBI and looks experienced. I would have expected her to know the risks of working for NBI especially on a case that involves possible online fraud with several dozens of victims. The victims are bound to share info with one another online unless perhaps she specifically asked the people she gave her name and email address to to not share the info with others. Anyway, I deleted her name and email from the previous post. According to her, if you want to get in touch with her, you can call up NBI and just ask for the attorney handling the Cleverbuy case; her colleagues already know who to pass the call to.

Mr. Edgardo Garcia was also present in the meeting along with his lawyer Atty. Jorrey Sampior. Atty. Sampior is a personal lawyer of Mr. Garcia; he does not represent Cleverbuy, but only Mr. Garcia.

The biggest twist in this issue is that Edgardo Garcia himself is now pursuing a case against Christian Bayer. According to him, the reason they kept quiet before was because they still believed that Bayer would fix the financial mess and that Cleverbuy would thus settle all the refunds and the accusations thrown against the company and the employees. When Bayer disowned Cleverbuy and fled the country just a few days ago, that was when Garcia and the other remaining employees knew for sure that Bayer was running away from all his responsibilities.

They are now working with NBI to study their options on how to pursue Christian Bayer.

According to him, if his lawyer would not be able to defend him, he was willing to go to jail since he was already old and had had his days. But he would turn state witness if given the chance. Regarding refunds, he said that they were talking with Mozcom to get the money still with Mozcom and that Cleverbuy was considering filing for bankcruptcy so that they could liquidate the remaining assets and use the money to pay back their clients.

Also according to Garcia, they had to close their bank account as per the advice of their financial advisors. Otherwise, the account would incur more penalties. When asked about why the company collapsed, he claimed that it was due to mismanagement of funds -- very aggressive spending for events, expansion, etc. Garcia and Atty. Sampior accepted demand letters addressed to Garcia but did not sign them. He would review the letters, Atty. Sampior said.

Later on, Rolly Junto also spoke with some of us and said that the (ex) employees were also filing complaints at the Department of Labor and Employment (DOLE). Garcia's group also said they were thinking of a way to provide a centralized way to disseminate information.

As far as I know, former Country Manager Chris Aranez and any representative from Trip Toe Travels were not in the meeting. In case I'm mistaken and any of you got to talk to them, please let us know. It would have been interesting to hear their sides of the story.

This post gives some more insight on what happened to Cleverbuy behind the scenes. The post is supposedly written by Rolly Junto.

One of our partner merchant is J2 Discount Travel and Tours, owned by Christian Gorg Bayer. They provide us package deals like Coron tour package, Boracay tour package, Puerto princesa tour package and Bohol tour package in a very low price, no, in a negative price. The costing of 1 package will reach up to 15,000 pesos including the airfare and accommodation but CleverBuy is selling it for only 9,900 pesos. You may ask me why CleverBuy is selling this kind of service in a negative price. According to Mr. Bayer this is only to generate more income, to have an enticing look and to have instant cash.

If everything in the post is accurate, then it seems that the Cleverbuy travel deals were set up as a pyramid scheme. The travel deals generated negative income; the money from new transactions was the one that made the earlier travelers able to redeem their vouchers. The cheap (negatively-earning) travel deals, coupled with very aggressive and very expensive expansion and marketing efforts here and abroad widened the customer base fast and earned the owners some fast cash. The high expenses and some of the money being siphoned off to Bayer's other companies soon caught up with the company and, along with the P5 million paid to TripToe, depleted the funds.



So what happens now?

I suggest call up your banks, explain what happened -- making sure that they understand that the transaction was fraudulent and a criminal investigation is underway -- and request them to return your money. The more recent you bought your voucher, the higher chance that the charges can be reversed.

I don't expect the funds still with Mozcom to be substantial and liquidating Cleverbuy's assets will take time (if it happens at all) since that will involve the cooperation of the company's missing owners and incorporators and their lawyers.

You can still file your notarized affidavits and other documents at NBI's Anti-Fraud Division (Room 503) or Computer Crime Unit (Room 508).

For those with claims below P100K, small claims procedure is an option. I can't provide more guidance about it though since I haven't really reviewed it.

Both Mr. Garcia and Atty. Sampior left their contact info. According to Garcia, he would entertain polite questions but not threats. He also said that he had instructed the guard at Marvin Plaza to accept letters on his behalf, so you can also address your letters there.

Another complainant also emailed me the following suggestions. I'm posting the complainant's suggestions verbatim:

The ones with the bigger claims could go to the House of Congress Committee on Trade and Industry. The lawyer of the complainants handling this case should submit a position letter to the congress. The representative of the complainants (or the one who has a high claim, or whoever is pursuing this case legally already) could request a meeting with a congressman who is part of that committee, better if the complainant is under the jurisdiction of that congressman. Please note that it is almost elections and it will do that congressman good to be seen in public. Since this has already been as subject of the media, the congressmen in charge of that committee would want to take a look at this issue. Cleverbuy representatives might be given subpoena to appear in the meeting, and the congressman could also summon the DTI secretary or representative regarding our complaint. My friend said that the congress cannot really tell Cleverbuy to pay up, but they will put a lot of pressure on this case so that it will be resolved.

Whoever also is pursuing this case could go to the Consumer Protection Party List. They have government officials who might be willing to look into this case. I am not sure as to the party list name, but my friend assured me there is one.

Updates: June 20, 2012 11am

1.  According to NBI:
  • When you accomplish the complaint sheet, you need not put names on the "Persons Complained Against/Suspect(s)" field. The investigation will determine the personalities behind this scam. Just put "unknown persons operating Cleverbuy".
  • You can submit your affidavit via courier. A cover letter should be attached to it stating that you are seeking/requesting investigative assistance on the fraudulent activities of Cleverbuy for you were victimized by the same and indicate your name, address, tel no., email if any and affix your thumbmark (in lieu of the complaint sheet which should be sworn before the administering officer of NBI) and a photocopy of a valid  ID (with  picture). You may address your letter to

2.  According to several commenters, Yoshinoya is now honoring Cleverbuy vouchers (out of good will perhaps). Better call Yoshinoya first before going, just to be sure.

3.  Different banks handle refund requests differently, whether the transactions are below or exceeding 60 days. One commenter reported getting his charge reversed by Metrobank even if his purchase date was March 2. Another commenter was told by Metrobank that the bank was willing to return his money but a cancellation letter from Cleverbuy was needed. Another one who paid via Metrobank Dragonpay was advised to visit or call the mother branch of Dragonpay which is in Rockwell Metrobank. Another victim was told by BDO to fill-up their dispute form and attach the proof of purchase and a photocopy of ID. If approved, the credit will be returned after 60-65 banking days. Other commenters were told by their banks to forward their complaints to Mozcom instead.

4. Something I found curious: During the meeting last June 8, Edgardo Garcia said that Christian Bayer had left the country, yet in Facebook, aside from denying that he is the owner of Cleverbuy, Bayer claimed that he was still in the Philippines as of June 10. Hmm.

  2. Hi, I just got in touch with my bank and they said that they would try to process a reversal of charges dated Feb 10(eek!). This would require feedback from the merchant (Cleverbuy), so i`m also not very optimistic on that one. I will try contacting Mr. Garcia and his lawyer on the contact details posted above and hope for a miracle..

  3. For those who purchased vouchers earlier this year: try to contact the hotel/inn included in your travel package. J2 might have already booked and already paid for the accomodation. Just make sure you still remember the target travel dates you have given them.

    You can also try to contact Zest Air or the other local airlines but chances that you are booked are very slim.

    1. Sorry Mavic but I have no experience with Prudentialife Plan so I don't know much about it. Several months ago, I asked a friend who works at Sunlife about it. All she said was that the problem was probably caused by the pre-need plans. I guess pre-need plans are a lot more complicated and unstable compared to ordinary insurance plans.

I heard from my friend this problem so i tried to call my bank and transfer me to the credit card processing and explain what happen. Before I hang-up my phone they temporarily credited that amount to my account. Please try to call your credit card company, they help you faster. Thanks..

  16. hi, my friends and i are also a victim of this scam.kaso hindi kami mismo yung nagpurchase from cleverbuy. binenta sa amin ng friend ng friend ko kasi hindi na niya magagamit yung voucher (dahil hindi nila mabook ng friends niya yung desired date nila sa j2) aalis na siya papuntang ibang bansa. ngayon we are trying to get the money back from her tapos ayaw na niya ibigay. sabi naman ng nbi dapat kung kanino nakapangalan yung transaction with cleverbuy sila ang magreklamo sa nbi (hindi kami) haaaay nakakafrustrate lang kasi parang nagiging cleverbuy na rin ang ugali nung nagbenta sa amin.ngayon dedma na siya sa amin :(

    2. I think you can file a small claims case against the buyer and that buyer can also file a small claims case against Cleverbuy. I think he must file it before leaving the country tho.

    4. Nope it's not required. But with NBI, it's a criminal case (so the defendant might end up in jail but us getting a refund is not guaranteed), a small claims case is civil and is usually done to get back money from those who owe us less than P100K.

    Anyway, I do hope one day na this will all be over and we can go back to this chapter in our lives and joke about it. Hope to see you again in better circumstances. Keep up the good work.       I'm not sure if you are one of the recipients of my email the other day, but I did send an email to the owner of this blog (and some other people) regarding other measures if we want this case to move a little faster, as per advise of my friend lawyer. I didn't get any reply from anyone though and it's kinda making me feel anxious haha.

      I would also like to know who is pursuing this case aggresively right now, as I would want to get in contact with them. I actually cannot take a leave at work since I'm new here, but it will be great if I could make contact through other means.

  22. I purchased my voucher last March pa. Nagpa-book ako ng travel sa August. Ang ikinakainis ko, before ako bumili sa cleverbuy, tinawagan ko muna yung travel agency (hindi po J2). Tinanong ko sila kung valid ba yung deal. Sabi nila, oo daw, bumili na daw ako at i-send ko sa kanila yung voucher para ma-block na yung date sa hotel. So, I purchased the deal and send the voucher to them. Tinawagan ko pa yung hotel, sabi, ok naman daw, Confirmed ang booking. When this mess came out, I called the hotel again to confirm, na-cancel na daw yung booking. So I called the travel agency, demanded na i-accommodate nila ako, because, they specifically said na ok yung deal na yun and I purchased knowing na they authorized cleverbuy to use their name. So, now, instead na cleverbuy ang habulin ko, hahabulin ko ang merchant because sa ating mga third party consumer, ang alam natin, partners sila. Merchant ang travel agency, marketing arm ang cleverbuy. Irregardless kung anong usapan nila ng cleverbuy, may responsibilidad pa rin sila na tanggapin ang vouchers natin, because we purchased in good faith. I am currently seeking advice from lawyers kung tama ba ang point of view ko. Hindi ko kasi habol na ma-refund. Ang habol ko po talaga ay magbakasyon.

  23. How were the merchants paid by cleverbuy? Was it when a customer buys a voucher from cleverbuy, cleverbuy will send a list of vouchers bought to the merchants and the merchants will collect the vouchers claimed from the customers and redeem the money from cleverbuy. And all the unredeemed/expired vouchers will be profit for the cleverbuy.

    If so, the merchants who knew that cleverbuy was not going to pay them was right in refusing to honor the vouchers of the customers so that they will not take a loss in their business since they will not be paid by cleverbuy.

    So, if the merchants would still honor the vouchers now, it would only transfer the problem from customer to merchant and i don't think anybody would like to lose money.

I would just like you all to know that I feel your plight, and I pray for all the victims of Cleverbuy that you all may have the strength and determination to see this through, not only to get your money back but to seek justice and see the perpetrators of this crime pay. I may seem idealistic but I think you all have the higher calling of ensuring that those responsible for this scam do not do this again to other people.     1. At least there's a screencaps that he is not planning to run away. I'm just wondering why on earth would they close their Chinabank account. It's really stupid (as I cannot find a politically correct term for this).

      I'm beginning to think they wanted this issue to reach NBI in the first place so they'd have a reason to close their company, declare bankruptcy and run away with our money. They probably also wanted to lower our morale so that their victims would not pursue the case till the end. No one goes to jail, no one pays for anything, no one takes responsibility. It's just the poor, duped customers who suffer.

  36. Yoshinoya honors cleverbuy vouchers! They have a list of the buyers, you just present the printed voucher to verify it from their list. I asked them earlier how do they get paid by cleverbuy since they are closed, and they just answered that the GM (General Manager) of Yoshinoya just said it was ok.

    My only comment was the waiter, he looks angry but maybe he was just having a bad day.

    P.S: I also bought their ice cream desert, so at least i bought something as a bit of thank you to the management since when i bought the voucher back then, i used the joker and 50 pesos win from their wheel of fortune. I think i only spent 146 pesos/around that amount for the yoshinoya voucher.

    I will be cancelling my credit card this year because of this. I didn't even get a reply from their customer service when I sent a dispute letter online last week.

  41. Thanks so much for sharing this. Actually I used my Metrobank card for our Clevertravel purchase and I emailed their Customer Service as soon as I heard of this issue. At first their CS told me that the company (Mozcom/Clevertravel) need to file a cancel procedure first. We totally lost our hopes on this. After a week or so, someone from their Authorization, Fraud and Chargeback team emailed me and informed me that they will start processing my complaint as soon as I submit the voucher as proof. My complaint's now being processed and they will be posting credit adjustments on my account. To those who used Metrobank card for purchase, I highly suggest you to email their Customer Service (customerservice@metrobankcard.com) and make sure to DETAIL the purchase details (date of purchase, paid to, reason for cancellation, amount, etc)

Metrobank card also reversed my transaction thru Paypal w Celverbuy. ok Sila becasue they reversed the full amount immediately and it is the merchant Cleverbuy who has to dispute the reversal within 45 days . the only way cleverbuy can dispute is if they give us active vouchers that will be honored and plane tickets. So in short naibalik pera namin, Thank God and Metrobankcard for being customer friendly and putting the onus on the fraudulent merchant to prove otherwise.

I showed the links online on the NBI investigation and that CLeverbuy offices are closed so no way for me to claim my vouchers. Got my reversal within a day. Halos karamihan ng nagwowork ngayon na sales at managers sa Dealspot ay galing sa CleverBuy nandun ang mga managers every monday to friday except saturday.   50. was able to redeem a voucher worth almost 20K package for 4 sa coron,palawan. very nice experience,hatid-sundo ng mga j2 sa palawan and accommodating ang staff ng divelink resort. sa sobrang ganda, i repeated the experience but i used a travel agency na since walang deal na offered ang clever (buti na lang din). when i talked to the resort manager of divelink, he told me na may utang pa ang J2/clever sa kanila na more than 800K. di daw kasi nila matanggihan ang mga cleints since galing pa sa malalayo kahit pa daw di nila makontak ang clever. humanga ako s akanila and at the same time, naawa. good thing na ang last scam nila sa akin id yung yoshinoya. to be honest di na ako umaasa an makuha yun pero was surprised na out of good will, nagpapa-claim na sila.
    when i got there, i talked to their manager and she told me na napilitan na sila ibigay kasi grabe na daw ang stress na nakukuha nila. karamihan daw kasi ng mga clients,di amniwala na di sila binayaran and pinagsasalitaan daw sila ng masakit. so para wala na daw gulo, ibigay na lang nila even if this means losing hundreds of thousands (you should their claiming list,ang kapal!) .

    1. ano po bank nyo? chinabank sa akin at nagfund transfer lang po ako ksi me account ako sa kanila, nagpunta na ako sa chinabank and told me na naremit na daw nila ang payment kasi last year pa po ang transaction. me permission naman daw ako, sabi ko naman natural lang na me permission to transfer a fund kasi all i know ay good ang cleverbuy. they told me na kontakin ko raw ang dragonpay pero sabi nila ay naremit na daw po nila sa mozcom. then when i contacted mozcom, sad to say, ni "hi" or "hello" ay wala po silang reply. niresent ko ngayon and hoping to get a response from them next week.

  53. very nice ang staff ng yoshinoya when we redeemed our voucher from cleverbuy, thankful pa rin ako kasi ni-honor nila yun. In fact sila pa ang ngsend ng SMS sa akin para ma-claim yun voucher, kala ko kasi wala na yun kaya di na ko ngfollow up after na ngcall ako at iwan number ko sa knila 3 wks ago. Kaya thankful na rin ako kasi may mga merchant pa rin pala na marunong magbigay ng proper service sa customers nila kahit di sila nabayaran ng Cleverbuy. Sana may iba pang merchants na makagawa nito, and surely in future may good karma din ito sa kanila. Thanks Yoshinoya!

My Bank reverse the payment that i made last april 20, 2012 amounting to 27,600.00 thank god. pero iimbestigahan pa din nila in 75 days. if proven na naloko nga ako hinde na ako magbabayad. and since na sarado na ang cleverbuy mapapatunayan naman na nagsasabi ako ng totoo...sobrang para akong nabunutan ng tinik. so i suggest na tumawag kayo sa mga bank nyo. what i did was i called my bank and told me na i make a formal complaint letter to be fax sa fraud division they will give you the number.....so hinde na ako para magreklamo pa sa NBI.....THANK YOU LORD....Please if you paid via credit card protektado tayo.....

I made the letter 1st week ng june lang 2012 nung pumutok na sarado na ang clever buy...i called yung call center nila and i was advised to make a letter to be addres sa fraud dept. I wrote what happened attached my transaction slip and told them that the cleverbuy already closed down. Kung baga ikukuwento ko yung totoong nangyare....i have a good record sa bdo siguro isa rin yun kaya na grant ako...plus totoo naman na sarado na sa cleverbuy. I also told them na via mozcom ako nagbayad though the transaction is valid d ko naman nakuha yung worth ng money ko....

  63. Isa ako sa mga nagpurchased sa cleverbuy way back Nov.7 2011. Sa awa ng Diyos natuloy din ang naging travel namin na Bohol Tour package for 4 persons worth 15999. Pero bago natuloy yun, sangkatutak na hirap ang dinanas namin sa pabalik balik na pagpunta sa Cleverbuy office na sarado na pala. Ang nakausap ko ay si Rolly Junto na marketingmanager ng scam na ito. Buti nalang at nagawan nya ng paraan na matuloy ang travel namin nito lang may 25-27.pero bago yun muntik na din akong mapasama sa mga taong dapat aymagrerefund nalang ng pera dahil sa walang update ng j2 travel, napanood ko din ang mga reklamo ninyo sa abscbn news. Naaawa ako sa inyo dahil naloko kayo ng walang kwentang group buying site nanito. Advise ko lang sa inyo, wag nalang kau magpurchase ng online gaya ng mga ganito.   67. for those who paid by credit card (any bank) as long as within 60 days since the transaction date, you can file dispute letter and they will investigate in 75 days what really happened. Please make a letter just relay the truth attached your proof of payment plus the billing of your card. In my case wala pang 30 days na actionan na kaagad, ni reverse na nila yung payment ko i filed last june 03, now at my july billing reverse na....April 20 ang transaction ko..May mga number ng mga banks nyo sa billing statement dun kayo mag inquire ibibigay ng costumer service ang fax number ng fraud division...TIME IS THE ESSENCE HERE...PAG lampas na ng 60 DAys ang transaction HINDE na nila inaallow kase nakabayad na din sila. SO sa NBI na kayo dumerecho....for those who paid in cash im sorry to say hinde sya inoonor ng dispute team because its consider as a valid transaction NBI na din yun....Im speaking base on my experience...i refunded my money amounting to 27,600.00 with in 60 days i applied for dispute then after 30 days the bank reverse my payment.....BASTA WITH IN 60 days na transaction na pag asa pa...pag lampas na hinde na pwede....call me 09159686263 il be willing to help you dahil pare pareho naman tayong victim dito....

    1. hi alam mo ba ung sa eastwest ko ayaw nila irefund money ko, sabi mki coordinate daw kame sa mozcom. at ang mozcom naman sabi nila nabayad na daw nila sa clever buy, we have the same date of transactions :(

    2. just get the number of fraud division then make a letter wag ka na makipag usap kung kanino man at sayang sa oras. I thank BDO very accomodating sila. they assist me and told me the procedure...Depende di kase yan sa letter mo kung paano mo ilalahad yung pangyayare dapat wag ka rin mayabang or wag mo rin impose...ask a favor makiusap ka...kase di rin naman kasalanan ng banko na naloko tayo to begin with. itry mo lang kung pumayag thank you kung hinde naman sa NBI ka na dumeretcho...Ganun lang kase ako nga June 3 palang nag email na ako....nag file din ako sa NBI i emailed MOZCOM too....lahat ng option ginagawa ko na sobrang greatful lang ako na may tumugon sa request ko at nakatulong din ang mozcom for validating may trasaction at pinatunayan nila sa BDO na sarado na nga ang clever buy.....wag na kayo umasa sa mga comments dito walang mangyayare kung basa lang kayo ng basa.....Action, gamitin nyo instinct nyo...

I bought the voucher Apr23 using Citibank credit card, then posted my payment May 3.After the hell happened in Cleverbuy, I filed a dispute on citibank dated june 12, within seven days, they reversed 27600 to my account.. then june 28, they charged back the 27600.. :( saying that the given proof is not valid.. they are requiring further proof in order to proceed with the investigation.. July 18, I faxed them another statement telling my story about clever buy.. when I called them for follow-up, they told me of 60 banking days investigation.. I need the money na talaga and i can't wait for 60days pa.. Can u please tell me how you contacted Mozcom to help speed-up citibank's investigation? It is really frustating that Citibank are asking for more proof eventhough I already gave them the site in which cleverbuy has already been televised in TV patrol.. What more proof does Citibank need? Even a person with only a half brain can understand the situation in a minute they go to internet and search the cleverbur reviews.. tsk.. tsk..   68. Hi, I heard that the owner of Cleverbuy is the same owner as of CashCashPinoy (they even have the same first letter). I contacted him under frederic@cashcashpinoy.com and he actually promptly replied and promised me a refund (full refund!) within 10 days. I am pleased :)

  72. Shame on Ensogo or Metrodeal if they're the ones spreading these craps!!! CASHCASHPINOY IS NOT AT ALL AFFILIATED WITH CLEVERBUY! In fact, if you talk with DTI people, they'll tell you that cashcashpinoy and Dealgrocer, are the really two only serious groupbuying websites: no problems with them with DTI. Everything situation is always fixed for the benefit of the consumer.
    So instead of spreading scam and craps, give us some real intels how to get back our money from these cleverbuy scammers.

Are you a cashcashpinoy or dealgrocer fan? good thing that you mention 2 illegal companies at the same time. cashcashpinoy is currently being investigated by BIR for tax evasion and dealgrocer is a company from hong kong doing business illegally in the philippines because they lack any business local registrations which are required if you are processing money here locally (which they are doing, they even provide their own personal savings accounts for depositing money). fanboy much?

    just got my refund from BPI, transaction was made on April 2 amounting to 16k for a bohol trip. I made a request on 2nd week of June, including submission of required documents. Just make a request letter (details of incident), proof of purchase (printed voucher), and credit card and billing. Hope this information would be a help for you.

    1. That was a stupid thing for Citibank to do. Why the hell would they refund your money in the first place? I don't think you can expect any kind of help from Mozcom. I just got a letter from them, reiterating that they are just a payment gateway and has no responsibility even if the merchant fails to deliver.

In the complaint sheet at NBI, you don't even have to specify names, you can just put "the people behind Cleverbuy" because according to NBI, they'll be the one to investigate and find out who the guilty people are (if any). Besides, Cleverbuy is/was a corporation, not just solely owned by Christian Bayer.

    1. That's exactly the same brush-off message I got from Mozcom. I think Mozcom has stopped responding to refund requests from Cleverbuy victims. Based on other people's comments, it seems that Mozcom will only cooperate if the requests come directly from banks. Contact your bank for your refund request.

    In relation to this post about Mozcom, I'm thinking about what they will do about the money they have on hand for refund if they didn't get an advice from Cleverbuy that we’re requesting a refund based on their suggestion.

    Is there anything we can do to drag Mozcom on this being uncooperative on this matter?

If you have used a credit card for your purchase with cleverbuy then the procedure for getting your money back is to make a CHARGEBACK claim, (NOT a refund) with the bank that issued your credit or debit card. You will get your money back from your bank. It is then upto Mozcom's banking partner to obtain the funds from Mozcom (payeasy) and return it to your bank.

      If Mozcom fail to return the funds to their banking partner there will be serious ramifications for them.

    So I was really down and I lost hope.But upon checking with HSBC last Monday, Aug. 13, the amount that I had disputed was credited back!
    Am so thankful that they understand the situation and assisted in having my money back.
